Mary's latest re-trial is set to begin on 20th October 2004
-- She is charged under Irish law with 'criminal damage without lawful excuse' for using a fire-axe to disarm a US Navy 737 at Shannon Airport, Ireland, in the run-up to the attack on Iraq in Jan 2003. On July 3 2003 that's what US citizen and ex-Marine Scott Ritter, former UN weapons inspector in Iraq, said when he spoke in Galway, Ireland, in support of Mary Kelly, whose trial had concluded earlier that day. The major charge against her: ‘criminal damage without lawful excuse’ to a US warplane at Shannon Airport, Ireland. Ritter had come to Ireland to testify as a witness, but his testimony was hindered by the trial judge. The jury split on the verdict, so Mary received a reprieve - until the Director of Public Prosecutions in Ireland decided to re-try her on the same charge.
Justice?
Mary's second trial in June 2004 collapsed when she was literally abandoned in the courtroom by those who had been engaged to protect her best interests. Rather than ask the judge to force disclosure of the legal advice given by the Attorney General to the Irish government relating to the illegal use of Shannon Airport for this war, her legal counsel suddenly resigned.
Justice?
On October 20, 2004 Mary's third trial will begin. She has been denied legal aid for expert witnesses and faces massive costs. Her case file has been withheld by previous counsel, obstructing her from briefing new counsel. Now she is forced to represent herself.
Justice?
Mary's courageous action to save human life highlighted the complicity of the Irish government in this war – they continue by facilitating fuelling stopovers at Shannon Airport for US warplanes en route to the Gulf. The Irish Constitution clearly states: 'War shall not be declared and the State shall not participate in any war save with the assent of Dáil Éireann.' (Article 28.3.1)
Dáil Éireann (the Irish parliament) has been misled that this assistance to the aggressor plays no part in this dirty war.
But we, the People, are not so easily fooled - We will not stand by and allow the Irish government to use Mary Kelly as a scapegoat to cover for its own crimes.

Shannon Airport in Ireland continues to be used intensively by the US military for the refuelling of planes, carrying troops and terror weapons en route to commit war crimes in Iraq. (Weapons include napalm, cruise missiles and depleted uranium.) The same US warplanes refuel at Shannon on their return journeys carrying the spoils of war: flag-draped coffins of their dead for rapid burial in USA, kidnapped torture candidates to Guantánamo Bay in Cuba, irradiated and amputee veterans for disposal somewhere out of mind. The 'neutral' Irish government is fully aware of this situation.

The charges on Mary Kelly should be immediately dropped. An investigation based on the Nuremburg Pinciples should be initiated into all Irish institutons commplicit in this ongoing crime that has reduced Iraq to chaos, has claimed the lives of thousands of Iraqi children has militarised Shannon Airport.
The cynical psychobable of Nicola & other detractors is a poor cover for moral cowardice.
Solidarity with all nonviolent resisters to the war in fornt o civilain courts and military courtmartials, in prisons and brigs and further nonviolent reistance to the war is essential.
Attention seeking rubbish like that Dubsky idiot. I think anyone who goes charging into an airport swinging a fire axe deserves to be locked up and taught a lesson, plain and simple. Such stupidity and misdirected attention seeking frustration must not be encouraged.

The U.S. war plane disabled by Mary Kelly, and then later by the Pit Stop Ploughshares, was on it's way to the war zone before it was disabled. After the two nonviolent diarmament actions the US Navy war plane was returned immediately to its base in Texas.
This may have been the only piece of military equipment turn around in mid-journey to the war by the western peace movement.
Whether it was a significant action or not is up to your world view....rsignation ot the empire's bloodletting or acting on behalf of the children a future for them and us.

First of all in the above article the writer says that the U.S aircraft traveling through Shannon Airport are carrying such weapons as napalm,cruise missiles and depleted uranium this is complete bollocks, where is the proof ? Has anybody seen these so called flag-draped coffins, or the prisoners enroute to guantanamo bay or for that fact even a flight plan for an aircraft from shannon to guantanamo bay, the answer is no! For the record states that the aircraft Mary kelly unlawfully damaged was enroute to the gulf, this is also untrue the aircraft in fact was enroute to Italy where that squadron is based,he also states that the aircraft was returned to its base in Texas immediately, this is also untrue, the aircraft stayed in shannon until the plane was fixed and then when they were ready they returned to boeing's airfield to have the aircraft resprayed. Maybe fairview against the war and for the record should get there facts straight before they start printing lies on the net !! Also i hope that Mary Kelly is punished accordingly for crime that she committed and i believe she will be!!

The US Navy war plane was en route to the war zone through its US base in Siciliy. Of course it had to be repaired (twice) before it was sent back to Texas.
