Remarks by judge Sean O Donnabhain, Cork

Not happy with judge's remarks

RCNI legal director is not at all happy with judge Sean O Donovan's remarks in court.

However, it is alleged that this is not the first time that this judge has used colourful language in court.

Its interesting to read Michael Mc Dowell's article in the Sunday Independent, May 15th 2011, where he states "Typically, a solicitoror barrister in her or his mid-fifties is chosen on the basis that he or she has demonstrared intellectual capacity, independence of mind, and teperamental suitability to serve for 15 years with a retirement age of 70 (previously 72)"

Im afraid this judge showed very little intellectual capacity here.

We have the Laws Society who is supposed to be monitoring the solicitors.., but who is monitoring the judges. More importantly, the public have no recourse if a judge over steps his authority, an makes a biased judgement, based on his own whims.

Surely a Judge should not be allowed to make judgements or form opinions, by taking into account ones occupation.

Today, in the Cork Circuit Court, judge Sean O Donnabhain reversed his ruling made yesterday, jailing a Garda for 3 years for beating Stephen Gerard Murphy half to death.

Garda, Dean Foley, was not sent to jail because he was a guard, and it was feared that he may be attacked in jail because he was a Garda. Why could'nt this Guard be isolated in prison ?

Isnt this just fantastic, all the other Garda now in the country, can beat a person half to death, knowing that they will not be sent to jail. (only be sure to get judge Sean O Donnabhain as the judge).

If an "ordinary" member of the community commited such a crime, this judge, so called, would show no mercy, and commit that person to prison straight away.

This is how justice is done in Ireland, it all depends on who you are, (according to this knowledgeable judge) !

Amazing, absolutely amazing. You both lament that his occupation is brought into consideration but yet his occupation is exactly why it was GSOC who inverstigated this matter.

Can none of you see the idiocy of your views when its exactly the likes of you that demanded special treatment in the beginning

Clearly, a precedent has now been set.

Every Garda in the country, can now beat a person up, and know they will not go to jail for it.

more signal than precedent. Stay quiet, the dogs are licenced. This has always been policy for the poorer sectors, it only shocks the sheltered. A warning to middle classes, stay in line. None of that solidarity shit round here. Accept your crumbs, while we pretend to fix it.
